Supporting legal framework development in Cambodia

Description

In August 2011, the Government of Cambodia passed Sub Decree 190 on Sending Workers Abroad through Private Recruitment Agencies. While this Sub Decree was generally considered to be an improvement on the previous Sub Decree 57, the Ministry of Labour and Vocational Training (MOLVT) indicated a number of areas in which additional guidance would be provided in the form of ministerial regulations (prakas). ILO's Australian Government-funded GMS TRIANGLE project (Tripartite Action to Protect Migrant Workers within and from the Greater Mekong Subregion from Labour Exploitation) offered assistance to the Ministry in the drafting of the prakas. The project team helped determine the scope and number of the prakas planned, assisted the MOLVT in the formation and composition of a Technical Working Group (TWG) and provided support for meetings and broader consultations with social partners and civil society organisations. The ILO also submitted technical comments on the draft prakas, drawing on relevant international standards and experience from the region. The regulations strengthen existing protection mechanisms for migrant workers and set standards for private recruitment agencies, the recruitment process, and pre-departure orientation trainings. Training sessions on the regulations have been provided to recruitment agencies, Ministry and provincial Government officials, village and community leaders, NGOs, trade unions and other civil society organisations.
